NOTICE OF CONFIRMATION OF A PUBLIC PATH DIVERSION

NOTICE OF CONFIRMATION OF A PUBLIC PATH DIVERSION AND DEFINITIVE MAP AND STATEMENT MODIFICATION ORDER HIGHWAYS ACT 1980 WILDLIFE AND COUNTRYSIDE ACT 1981 NORTH YORKSHIRE COUNTY COUNCIL FOOTPATH 25.41/5 AND FOOTPATH 25.41/6, WELLFIELD FARM, GREAT HABTON DIVERSION ORDER 2013

On 5 February 2014, North Yorkshire County Council confirmed the above Order made under Section 119 of the Highways Act 1980 and Section 53A(2) of the Wildlife and Countryside Act 1981.
The effect of the Order as confirmed is to divert the public footpaths described below and modify The Eastern Part of the County of the Former North Riding of Yorkshire Definitive Map and Statement accordingly.
Footpath 25.41/5 (first section). The original line of the path commencing at SE7595 7651, and running generally east for approximately 370 metres to SE7626 7645 shall be diverted on to a new route to the north commencing at SE7595 7652 and running east for approximately 320 metres to SE7626 7645 where it joins the continuation of the way. There are pedestrian gates at each of the field boundaries. Footpath 25.41/5 (second section). The original line of the path commencing at SE7629 7653 and running east-south-east for approximately 332 metres to SE7659 7640 onto a more northerly line, following the northern field boundary between the same points. Footpath 25.41/6. The original line of the path commencing at SE7659 7640 and running generally north-east for approximately 714 metres to SE7713 7668 onto a new route commencing at SE7680 7630 , and running generally north-east along a field edge track to SE7713 7668 where it joins the continuation of the way. A copy of the order as confirmed and the Order Map have been placed and may be seen free of charge during normal office hours at Malton Library, North Yorkshire until 2 April 2014. Copies of the Order and Map may be purchased there at a cost of £2.50, or can be downloaded free from our website www.northyorks.gov.uk/pathnotices. The Order comes into force on the date on which the Authority certifies, in accordance with Section 119(3)(b) of the 1980 Act, that work to the new section of path, described in part 2 of the Schedule, has been completed, but if a person aggrieved by the Order wants to question its validity, or that of any provision contained in it, on the ground that it is not within the powers of the Highways Act 1980 as amended, or on the ground that any requirement of the Act, as amended, or of any regulation made under the Act has not been complied with in relation to the Order, he or she may, under Paragraph 2 of Schedule 2 to the Act as applied by Paragraph 5 of Schedule 6 to the Act, within six weeks from 19 February 2014, make an application to the High Court.
